Acceptable Use Policy

This Acceptable Use Policy ('AUP') governs the use of CapEngage's SaaS platform, autonomous AI agents, APIs, customer data platform, and omnichannel messaging infrastructure. This AUP applies to all customers, account administrators, developers, and end-users.

Using CapEngage requires strict adherence to this AUP. Violations may result in immediate suspension or termination of your account without refund.

You may not access or use CapEngage to engage in any of the following prohibited behaviors:

• Illegal Content & Malicious Software: Uploading, transmitting, or distributing malware, viruses, spyware, phishing lures, or material promoting unlawful acts. • System Interference & Hacking: Attempting to probe, scan, or test the vulnerability of CapEngage systems or networks without explicit written authorization. • Unauthorized Scraping & Reverse Engineering: Reverse engineering, decompiling, or using automated bots/scrapers to extract source code, AI prompts, model weights, or system architecture. • Service Impairment: Conducting denial-of-service (DoS/DDoS) attacks, launching excessive rate-limit bypasses, or overloading shared database infrastructure. • Multi-Account Fraud: Creating disposable accounts or manipulating IP addresses to exploit free evaluation tiers or evade rate limits.

CapEngage maintains zero tolerance for unsolicited spam, purchased mailing lists, or unauthorized messaging dispatches across any communication channel.

When configuring CapEngage AI Autonomous Agents, Visual Agent Builder, or AI Copilot features, you agree NOT to:

• Deploy AI agents to impersonate human customer service representatives or sales agents without disclosing that the interaction is AI-driven where required by law. • Generate deceptive financial advice, medical diagnosis claims, or illegal contract impersonation. • Generate hate speech, harassment, sexually explicit content, CSAM, or material depicting violence. • Bypass AI model safety filters or inject malicious system prompts designed to jailbreak foundation LLMs. • Extract or attempt to harvest proprietary prompt templates or AI workflow logic.

CapEngage continuously monitors platform deliverability metrics, API rate limits, and abuse reports.

If we detect excessive bounce rates (>2%), spam complaint spikes (>0.1%), or AUP violations, CapEngage reserves the right to immediately pause campaign dispatches, throttle API access, or suspend Customer's account pending investigation.
