Law Enforcement Request Policy

This policy outlines CapEngage's procedures for handling law enforcement and government data requests.

1. Policy Overview

CapEngage is committed to protecting user privacy while complying with valid legal requests from law enforcement and government agencies. This policy establishes our procedures for handling such requests.

We carefully review all government requests and challenge those that are overly broad, vague, or not legally sufficient.

2.2 Required Information

All requests must include:

  • Official letterhead or agency identification
  • Name, badge number, and contact information of requesting officer
  • Specific description of information requested
  • Relevant dates and time periods
  • Legal basis for the request (subpoena, warrant, court order)
  • Certificate of compliance with relevant laws

2.3 International Requests

International requests must follow mutual legal assistance treaties (MLATs) or other applicable international agreements.

3. Request Review Process

3.1 Legal Review

All requests undergo legal review to ensure:

  • The request is legally valid and properly issued
  • The scope is appropriately narrow and specific
  • Compliance with applicable laws and regulations
  • Protection of user rights and privacy

3.2 Challenging Overbroad Requests

We may challenge requests that are:

  • Overly broad or vague in scope
  • Not supported by sufficient legal basis
  • In violation of user privacy rights
  • Not procedurally proper

3.3 Response Timeline

We respond to valid requests as expeditiously as possible, typically within 10-30 business days depending on complexity and scope.

4. User Notification

We notify affected users of government data requests when:

  • Legally permitted to do so
  • Not prohibited by a gag order or similar restriction
  • The request is for user account information

When prohibited from notifying, we will challenge gag orders to restore user notification rights.

5. Types of Requests

5.1 Emergency Requests

Emergency requests involving imminent danger to life or safety may be expedited. These require:

  • Clear evidence of emergency circumstances
  • Specific and limited information request
  • Documentation of emergency nature

5.2 Routine Requests

Routine requests for account information, records, or other data follow standard review procedures.

5.3 Preservation Requests

We may preserve data in response to preservation requests while formal legal process is obtained.

6. Transparency Reports

CapEngage publishes transparency reports including:

  • Number of government requests received
  • Types of requests received
  • Percentage of requests challenged
  • Percentage of user notifications provided

7. Data We Can Provide

In response to valid legal requests, we may provide:

  • Account registration information
  • Account activity logs
  • Communication metadata (timestamps, routing information)
  • Content stored in user accounts (where legally required)

We do not provide encryption keys or access to encrypted data unless legally required and technically feasible.
