CapEngage respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. This policy outlines our procedures for handling copyright infringement claims.

We take copyright infringement seriously and will respond to notices of alleged infringement in accordance with the DMCA.

2. User Content and Copyright

Users are responsible for ensuring they have the right to upload, store, or transmit content through our Services. By using CapEngage, you represent and warrant that:

  • You own the content or have obtained all necessary permissions
  • The content does not infringe on any third-party intellectual property rights
  • The content complies with all applicable laws and regulations

CapEngage does not pre-screen user content but reserves the right to remove infringing content upon notice.

3. DMCA Takedown Procedure

3.1 Reporting Copyright Infringement

If you believe your copyrighted work has been infringed on our platform, please send a written notice to our designated agent including:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the material claimed to be infringing
  • Your contact information (address, phone, email)
  • A statement of good faith belief that use is unauthorized
  • A statement that the information is accurate under penalty of perjury
  • A statement that you are authorized to act on behalf of the copyright owner

3.3 Response to Notices

Upon receiving a valid DMCA notice, we will:

  • Promptly remove or disable access to the infringing material
  • Notify the user who posted the material
  • Attempt to notify the alleged infringer of the takedown
  • Provide information for counter-notification if applicable

4. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification including:

  • Your physical or electronic signature
  • Identification of the material that was removed
  • A statement under penalty of perjury that removal was mistaken
  • Your consent to jurisdiction in your local federal district court
  • Your contact information

Upon receiving a valid counter-notification, we may restore the removed material after 10-14 business days unless the copyright owner files a lawsuit.

5. Repeat Infringer Policy

CapEngage maintains a repeat infringer policy:

  • Users who receive multiple DMCA notices may have their accounts suspended
  • Accounts terminated for copyright infringement may not be reinstated
  • We reserve the right to terminate repeat infringers at our sole discretion

6. Fair Use

We respect fair use principles under copyright law. Content that constitutes fair use (criticism, commentary, news reporting, teaching, scholarship, or research) may be permitted even if it includes copyrighted material.
